Brady Kiser, the father of Trigg Kiser, will not be charged. It was this pain that forced Arkie, whose son tragically drowned in the family’s backyard pool in Chandler, Arizona, earlier this year, to act. The Maricopa County Attorney’s Office made the notable announcement of this decision because there is “no reasonable likelihood of conviction” against Brady Kiser.
In May, Brady Kiser was home alone with the couple’s two young sons when the accident happened. After police officers showed up on the scene and conducted CPR on Trigg, she died the next day. Surveillance video from the property–the only video evidence of the incident–was the critical piece of evidence that outlined the exact timeline of events which led to the drowning.
>Through an afternoon Zoom press conference, Maricopa County Attorney Rachel Mitchell further clarified that upon evaluating the case there was not enough evidence to charge Brady Kiser. She stressed that her office takes a close look at each case brought before them. They decide if there is a reasonable prospect of conviction for each charge.

In a statement to the media, police made clear that they had indeed recommended felony child abuse charges against Brady Kiser. Mitchell explained that in order to get a conviction, it must be proved beyond a reasonable doubt. It needs to prove that he knew he was ignoring a serious and grossly disproportionate risk, conducting himself much more extremely than a reasonable person would under the same conditions.
Brady Kiser’s attorney, Flynn P. Carey, expressed gratitude for the thorough investigation conducted by law enforcement and the county attorney’s office. He stated, “We are grateful to law enforcement and the county attorney for conducting a thorough investigation and confirming that this was a tragic accident.”
