In line with this, Meta has set up a $50 million compensation fund for Australian Facebook users affected by the Cambridge Analytica data breach. This new program went into effect on June 30, 2023. Its purpose is to assist the more than 311,000 users who have been harmed by the unauthorized use of their personal information. Although the Treasury’s claims process will be open until December 31, 2023, initial payments on claims are expected to start by approximately August 2026.
An investigation by the Office of the Australian Information Commissioner found that Cambridge Analytica misused the “This Is Your Digital Life” application. In doing so, they obtained sensitive user information without a user’s consent, resulting in this substantial settlement. Only 53 Australian users actually installed the app. A pretty shocking 311,074 of their friends had their data accessed, making a compensation program essential.
Claimants have the option to apply under two classes: Class 1 and Class 2. Class 1 claims will be prioritized throughout the assessment process. Even if a claimant’s Class 1 application is denied, they might still be eligible for a Class 2 payment. As it stands now, all successful Class 2 claimants will get the same payout. The specific figure will be known only after the Class 1 payouts are set.
The specific payout will be kept confidential. Comparable compensation programs throughout the United States have distributed about $45 to each affected person. Meta has stated, “There is not a predetermined cap on payments,” indicating that the total distribution will depend on the number of successful claims made under both classes.
The new compensation initiative was a part of the terms of a legal settlement reached in December 2024 between the Australian Information Commissioner and Meta. This settlement was the impetus for the record payment program that aims to remedy concerns about data privacy and security.
To submit a claim, affected individuals have to select from one of two classes. Each class has unique evidentiary burdens that need to be met in order to successfully obtain their application. Eligible claimants can expedite their requests by applying through the new “fast track” application process. This method provides the developers an easier way to get their money faster.
